THE DETENTION
HEARING.
THE FBI'S OWN AGENT CONFIRMED
THE PHONE WAS TAKEN WITHOUT A HOUSE SEARCH WARRANT.
The FBI had already taken Teddy's iPhone from inside the house while Teddy was outside in custody. Six days later, the FBI's own agent had to answer for how they got it.
LEE: “NO.”
Lee also admitted the phone was not on Teddy when he was arrested and that another task-force officer seized it.
THIS WAS AGENT LEE UNDER OATH.
LEE TOLD THE JUDGE TEDDY DIDN'T OWN PHILCO.
THEN ADMITTED HE HAD NO WRITTEN CLAIM FROM TEDDY SAYING HE DID.
Philco was one of the central stories used to make the investment look fraudulent. But on cross-examination, Lee was asked whether he knew of any email or written communication in which Teddy told the investor that Teddy controlled Philco.
LEE: “NO.”
The records we've already examined go further: the investment documents did not identify Teddy as Philco's owner, the property documents put Philco on the other side of the transaction, and Teddy/Bear Industries were in a public lawsuit against Philco.
LEE COULDN'T POINT TO IT IN WRITING.
THEY SAID TEDDY WOULDN'T SHOW UP. THE RECORD THEY HAD SAID OTHERWISE.
The government portrayed Teddy as someone who ignored authorities and would not show up when required. It pointed to an SEC subpoena and his international travel.
But the defense told the judge there was no record before the court showing that subpoena had ever been personally served on Teddy. The pretrial-services record showed no prior history of failing to appear.
And when Lee was questioned about Teddy's travel, he admitted the FBI had no information that Teddy was on a watch list and acknowledged that, to his knowledge, Teddy's prior travel had been legal passport travel. Four days earlier, Teddy had flown back into the United States on his own.
THEY USED BEARLUTE TO CALL TEDDY A DANGER.
LEE ADMITTED HE KNEW OF NO BEARLUTE CRIMINAL CHARGES.
The government used BearLute to portray Teddy as dangerous. Then Lee was asked what criminal cases actually existed because of BearLute.
LEE: “NO.”
When asked whether federal criminal charges were then pending as a result of BearLute, Lee answered: “Not to my knowledge.”
THEY USED IT TO KEEP HIM IN JAIL ANYWAY.
THIS WASN'T TEDDY ACCUSING THE FBI. THIS WAS THEIR OWN AGENT. UNDER OATH.
NO WRITTEN PHILCO OWNERSHIP CLAIM LEE COULD IDENTIFY.
THE BIGLEY PURCHASE CONTRACT EXISTED.
TEDDY STAYED IN JAIL.
THE HEARING PUT THE FBI'S OWN WORDS ON THE RECORD.
Now compare those sworn answers with the evidence from the rest of the case.
